This is a revision of a currently
approved information collection entitled “Public Transportation
Safety Certification Training Program” (PTSCTP) associated with a
Final Rulemaking. OMB filed a comment on the NPRM on April 24,
2024. FTA did not receive any comments during the NPRM related to
the collection of information, burden cost and/or hours. Therefore,
there are no changes to the respondents, responses or annual burden
hours in this Final Rulemaking from what was previously submitted
to OMB during the NPRM phase. PTSCTP provides uniform training
requirements for Federal and State personnel and contractors who
conduct safety audits and examinations of transit systems and for
transit agency personnel and contractors who are directly
responsible for safety oversight. The program respondents are Rail
Transit Agencies (RTAs) and State Safety Oversight Agencies
(SSOAs). They collect and forward training information to FTA on
behalf of designated safety personnel. This is a mandatory
collection of information to assure that compliance with the
requirements is properly and earnestly undertaken by respondents
who are directly responsible for safety oversight of our Nation’s
public transportation systems. The PTSCTP Final Rulemaking are
discretionary changes that refine the PTSCTP communication process,
streamlines administrative requirements, and clarifies voluntary
PTSCTP participation and refresher training requirements. The rule
maintains the existing minimum training requirements for State
Safety Oversight Agency (SSOA) personnel and Rail Transit Safety
(RTA) personnel. These changes will ensure training requirements
and curriculum for safety professionals in rail transit agencies
are more responsive to changing industry needs.

This supporting statement is
associated with revisions proposed by a Final Rulemaking associated
with the previously approved information collection (OMB#
2132-0578) “Public Transportation Safety Certification Training
Program (PTSCTP)”. The discretionary changes in the Final
Rulemaking are not based on statutory changes but are rather
discretionary changes from FTA’s evaluation and administration of
the PTSCTP since 2018. During the management of the program, FTA
identified the need for new administrative requirements and
clarification in the regulation. The changes in this rulemaking
streamline FTA’s PTSCTP communication process with the transit
industry and clarifies the process for the evaluation of prior
certification and training. Included in these changes is the
revision of the term “refresher training” to “recertification
training.” This Final Rule also finalizes revisions to the
regulation to coordinate and align with other FTA programs and
safety rulemakings. FTA did not receive any comments on the
collection of information or the associated burden cost or hours
during the NPRM stage and therefore no changes have been made to
the IC summary of burden since the NPRM. In the NPRM, FTA updated
the burden table to show an increase in the total annual
respondents since the last regular OMB approval. Since then, there
was (1) additional SSOA and (4) new RTA’s, bringing the total
respondent universe to 95. The programmatic changes along with the
new respondents increased the total annual burden hours to
11,564.
